CONTRACT FOR THE SUPPLY OF GOODS OR SERVICES
The display of goods on this website amounts to an invitation to treat only and is not an offer to sell goods or services at any price indicated. No contract for the supply of goods or services will be deemed to exist between you (the Purchaser) and ThermaHelm Crash Helmets Limited (THCH) unless and until email notification by THCH has been made confirming acceptance of your order and receipt of payment.
This confirmation email amounts to an acceptance by THCH of your offer to buy goods or services and is effective regardless of whether or not it is received by you. You are free to withdraw from a prospective contract at any time prior to acceptance and for a period of 7 days following acceptance. In such a case you are required to write to THCH indicating your decision to withdraw and this should be received by THCH within 7 days of acceptance whereupon all monies will be repaid in full less any handling charge imposed by the payment provider.
For the avoidance of doubt, as these helmets are hand made to order, no goods are available for delivery to you (the Purchaser) until between 12 and 16 weeks from the date of your order. If THCH fail to deliver the goods ordered by the end of the sixteen week period you are entitled to request a full refund of monies paid. In this event you should write to THCH requesting a refund and THCH shall be obliged to provide this refund in full within 30 days.
RETURN / REFUND POLICY
ThermaHelm Crash Helmets Limited (THCH) operates a 7 day (from date of order) cancellation policy with full refund subject to deduction of any third party payment charges.
In respect of goods returned faulty or incorrect THCH will endeavour to replace within 7 days but in any event no later than 30 days.
Price and availability information is subject to change without notice. The above covers in full your rights in respect of the refund of any monies paid, and in any event you acknowledge that the only remedy for failure to supply, or late or incorrect supply can only be refund of monies. No other remedies whatsoever are implied or accepted.
SITE INFORMATION
THCH provides this website on an ‘as is’ basis and makes no representations or warranties of any kind with respect to the site or its contents including but not limited to warranties relating to fitness for a particular purpose or merchantability of goods advertised on the site.
PROCESSING OF ORDERS
Credit or debit cards will be debited upon receipt of order and you the Purchaser, acknowledge that this will be prior to goods being shipped for delivery. In accordance with above no goods will be available for delivery prior to March 2011.
LIMITATION OF LIABILITY
Except as specifically stated on this site, neither THCH nor any of THCH’s directors, employees or other representatives will be liable for any losses or damages whatsoever arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential losses and damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
ILLEGAL ACTS
It is a crime to use a false name or a known invalid credit or debit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic fingerprints of every order placed on this website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.
CHANGES IN TERMS
THCH reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the website.
Payment will be taken before the product is dispatched, further payment maybe requested if shipping to non UK location is required.
We reserve the right to request further confirmation of card ownership before despatching a product if we believe a fraudulent transaction has occurred.
